Dalmatian Fire Equipment, Inc. warrants to the original
purchaser that Dalmatian reconditioned SCBA and SCBA cylinder
products, the “Equipment”, will be free from defects in
materials and workmanship, normal wear and tear excepted,
subject to ALL restrictions and limitations described in this
document, for a period of 120 months from the date of purchase,
or until the end of the legal service life of the cylinder,
whichever is less. Any part found by Dalmatian Fire Equipment,
Inc. to be defective in material or workmanship within the
stated warranty period will be replaced or repaired without
charge for parts and labor subject to those limitations.
Dalmatian Fire Equipment, Inc.’s sole
liability under this warranty shall be to replace or repair
defects in materials and workmanship.
The Equipment subject to this Warranty Agreement is used and
Buyer acknowledges and agrees that Dalmatian Fire Equipment,
Inc. is not a manufacturer, supplier or distributor of the
Equipment. Other than the warranty described above Dalmatian
Fire Equipment, Inc. makes no warranties, express or implied,
including warranties of merchantability or fitness for a
particular purpose or with respect to patent or copyright
infringement, title or the like.
Dalmatian Fire Equipment, Inc. offers a free visual inspection
and function test after 24 months (shipping charges will
apply). This free visual inspection and function test is
required every 24 months to keep the warranty in effect for the
duration of the warranty period.
Dalmatian Fire Equipment, Inc. transfers to Buyer all
warranties, if any, made by the original manufacturer, subject
to original terms and conditions. The Buyer shall comply with
and enforce such warranties. Dalmatian Fire Equipment, Inc. is
not liable to Buyer for any modification or rescission of any
such original manufacturer warranties.
RESTRICTIONS AND LIMITATIONS
This warranty applies to all components of the SCBA products
(the Equipment) including all accessories and optional equipment
purchased and supplied at the time of original sale of the SCBA
products, EXCEPT as limited herein.
No Consequential Damages Consequential damages, lost productive hours, inconvenience and
contingent liabilities are not covered under this warranty.
Dalmatian Fire Equipment, Inc.’s sole liability under this
warranty shall be to replace or repair defects in materials and
workmanship.
No Outside Repairs or Alterations
THIS WARRANTY DOES NOT APPLY TO DEFECTS OR DAMAGE CAUSED BY ANY
REPAIRS OF OR ALTERATIONS TO THE SCBA PRODUCTS MADE BY OWNER OR
ANY THIRD PARTY. Only persons
specifically authorized by Dalmatian Fire Equipment, Inc. shall
perform warranty work on the Equipment. Any work performed by
unauthorized persons shall void this warranty.
No Misuse or Lack of Maintenance or Normal
Wear
Dalmatian Fire Equipment, Inc. does not warrant failure of parts
or components resulting from misuse, improper adjustment, lack
of proper maintenance or from general wear. During normal
usage, the materials on the interior of some cylinders may
develop minor pits which are acceptable under the DOT
regulations covering hydrostat testing at the time of original
delivery of cylinder to customer. Customer acknowledges that
some pitting is acceptable and not a warrantable item.
No Shipping Damage
Damage to the Equipment while being transported by a third
party carrier is specifically excluded from this warranty.
No Elastomeric or Rubber Parts or Lenses
This limited warranty does not extend to expendable parts such
as, but not limited to,
any elastomeric (rubber) components, face piece lenses, gauge
lenses and other plastic or elastomeric (rubber) parts since
they can be affected adversely by excess exposure to heat, sun
water or to other corrosive chemicals.
No Wires, Cables, Connectors
or Electronics Dalmatian fire limits warranty of cables,
wires, connectors and other electronic components to 90 days as
these as these can normally corrode, degrade, fray and lose
connectivity during the extreme usage in fire fighting
situations.
No Original Manufacturer Exclusions
Items specifically excluded from Manufacturer’s original
warranty are also specifically excluded from this warranty.
Replace or Repair Only
Dalmatian Fire Equipment, Inc.’s. Obligation under this warranty
is limited to replacing or repairing (at Dalmatian Fire
Equipment’s option) the SCBA, SCBA cylinder or SCBA components
that are determined to be defective by our authorized Dalmatian
Fire Equipment technicians. Only approved Dalmatian Fire
Equipment technicians are authorized to perform warranty
obligations.
Not Transferable This warranty is
applicable to the original buyer and cannot be transferred to
subsequent owners.
Void if Serial Number Defaced
THIS LIMITED WARRANTY BECOMES VOID IF THE SERIAL NUMBER AFFIXED
TO THE SCBA/CYL IS REMOVED, OBLITERATED OR DEFACED. Should our
technicians deem the malfunction a result of an accident,
alterations, misuse or abuse, the repairs will not be covered by
the limited warranty and the customer will then be responsible
for all shipping and repair cost. Written notification will be
provided before repairs are made in the event customer is deemed
responsible.
Serial Number Verification Required
PLEASE RETAIN THE POSICHECK TEST RESULTS FOR THE AIR PACKS AND
PACKING SLIP FOR THE CYLINDERS AS THEY CONTAIN THE SERIAL
NUMBERS OF THE UNITS AND WILL BE NEEDED TO CONFIRM THE WARRANTY.
RETURN PROCEDURES
WITHIN 120 MONTHS FROM THE DATE OF PURCHASE ANY DEFECTIVE
PRODUCT SHOULD BE RETURNED TO DALMATIAN FIRE EQUIPMENT, INC
WITH: 1) A RETURN AUTHORIZATION NUMBER (which can be obtained by
calling 970-278-1500); and 2) PROOF OF PURCHASE SHOWING SERIAL
NUMBERS (which are shown on the Posi-Check test results for
SCBA’s and on the original packing slip for Cylinders). AFTER
RECEIVING THE PRODUCT(S) DALMATIAN WILL MAKE FINAL
DETERMINATION OF WHETHER THE PRODUCT IS COVERED BY THE LIMITED
WARRANTY. IF THE DAMAGES ARE CAUSED BY ACCIDENT, ALTERATIONS,
MISUSE OR ABUSE, AS DEEMED BY OUR TECHNICIANS, DALMATIAN WILL
SEND YOU AN ESTIMATE FOR REPAIRS AND CHARGE YOU FOR RETURN
SHIPPING. IF THE DEFECTS ARE COVERED UNDER THE LIMITED
WARRANTY, DALMATIAN FIRE EQUIPMENT, INC. WILL REPAIR OR REPLACE
THE ITEMS AND RETURN THEM TO YOU WITH SHIPMENT PREPAID IF IN THE
US OR CANADA.
